DIVORCE LAW

MAINTENANCE LAW
Maintenance law regulates the financial compensation between persons who are close to each other and at least one of whom is not able to provide for his or her own living expenses.
In the case of so-called separation maintenance, on the other hand, the previous standard of living is decisive. Who is entitled to maintenance is regulated by law.
They can be children, spouses, ex-partners or parents. Unmarried couples may also be liable to pay maintenance to each other if, for example, a child has been born of the relationship.
CAREFUL
Parental care is the right to raise and the duty to care for and provide for a minor child. It is regulated in sections 1626 to 1698b of the German Civil Code (BGB). The law divides parental care into three areas:
- personal care,
- the care for the assets and
- the legal representation of the child.
The parents' duty of maintenance is independent of this. They are also obliged to provide financially for their child.
MARRIAGE CONTRACT
Under a Marriage contract is understood to mean a contract under private law between two spouses in which they lay down individual rules for the marriage, but especially for the case of a possible divorce, which deviate from the legal regulation.
Marriage contracts often specify the matrimonial property regime and thus the division of assets after the dissolution of the marriage, the equalisation of pension claims as well as regulations on post-marital maintenance.
