CERTIFIED PROCEDURAL COUNSEL<\/h2>\n

In child custody cases, a so-called procedural guardian can be appointed by the court to represent the interests of the minor child concerned in accordance with section 158 (1) and (2) FamFG. The guardian ad litem is not an additional lawyer for your child, but a person selected by the court at its due discretion who must be suitable to adequately represent the interests of your child according to the particularities of the individual case.<\/p>\n

The necessity of appointing a guardian ad litem as an \"expression of the subject position of the child in its individuality as a bearer of fundamental rights\" was only recently pointed out again by the Saarland Higher Regional Court (Saarland Higher Regional Court Saarbr\u00fccken, order of 17 June 2019 - 9 UF 49\/18 ).<\/p>\n
