In child custody cases, a so-called procedural guardian can be appointed by the court to represent the interests of the minor child concerned in accordance with section 158 (1) and (2) FamFG. The guardian ad litem is not an additional lawyer for your child, but a person selected by the court at its due discretion who must be suitable to adequately represent the interests of your child according to the particularities of the individual case.
The necessity of appointing a guardian ad litem as an "expression of the subject position of the child in its individuality as a bearer of fundamental rights" was only recently pointed out again by the Saarland Higher Regional Court (Saarland Higher Regional Court Saarbrücken, order of 17 June 2019 - 9 UF 49/18 ).
In which proceedings can a guardian ad litem be appointed?
The procedural guardian can be appointed in child custody cases pursuant to § 151 FamFG. These include:
- Custody proceedings
- Contact proceedings
- Child issuance procedure
- Proceedings concerning guardianship
- Guardianship or the judicial appointment of another representative for a minor
- Proceedings concerning the custodial placement of a minor
